Third judge rules against Trump move to end DACA
A third federal judge has rejected the Trump administration’s justification for winding down the program protecting immigrants who came to the U.S. illegally as children.

U.S. District Court Judge John Bates said on Tuesday that the Department of Homeland Security’s legal explanation for the decision to end the Deferred Action for Childhood Arrivals program, or DACA, was too flimsy and, ultimately, unpersuasive.


“DACA’s rescission was arbitrary and capricious because the Department failed adequately to explain its conclusion that the program was unlawful,” Bates wrote in his 60-page opinion, released on Tuesday evening. “Neither the meager legal reasoning nor the assessment of litigation risk provided by DHS to support its rescission decision is sufficient to sustain termination of the DACA program.”

Bates, who was appointed by President George W. Bush, is the first Republican appointee to rule against President Donald Trump’s move to wind down DACA. Two district court judges appointed by President Bill Clinton — one in San Francisco and one in Brooklyn — previously came to similar conclusions. They also entered injunctions requiring the administration to continue accepting renewals while litigation continued.

One judge in Maryland, also a George W. Bush appointee, upheld the basic thrust of the administration’s decision to end the program.

The Trump administration tried to bypass the usual appeals process and take one of those district court rulings directly to the Supreme Court, but in February the justices declined to take up the case before a ruling from at least one appeals court.

Trump announced in September that he planned to phase out the program, allowing renewals through March 5 of this year but then refusing to issue new permits. The arrangement would have resulted in about 700,000 people having their work permits and quasi-legal status expire over a two-year period.

The administration said the move was necessary to head off a lawsuit threatened by conservative state attorneys general who managed to block an expansion of the program under President Barack Obama. Bates, however, made clear on Tuesday that he did not find that to be a credible reason for the wind-down of DACA.

“The agency’s prediction regarding the outcome of threatened litigation over DACA’s viability — specifically, that the district court in the Texas litigation would immediately halt the program without any opportunity for a wind-down — was so implausible that it fails even under the deferential arbitrary and capricious standard,” Bates wrote. “DACA’s rescission will therefore be set aside.”

Bates is also opening up the possibility that the Trump administration could be ordered to take new DACA applications, something no other judge has required. Bates said in his decision on Tuesday that if DHS didn’t come up with a new, better explanation for the rescission within 90 days, the entire program would be restored.

A Justice Department spokesman, Devin O’Malley, said the administration remained convinced that its actions were lawful.

“Today’s order doesn’t change the Department of Justice’s position on the facts: DACA was implemented unilaterally after Congress declined to extend benefits to this same group of illegal aliens. As such, it was an unlawful circumvention of Congress,” O'Malley said. “The Department of Homeland Security therefore acted within its lawful authority in deciding to wind down DACA in an orderly manner. … The Justice Department will continue to vigorously defend this position, and looks forward to vindicating its position in further litigation.”

Bates’ new ruling came on a pair of suits: one brought by the National Association for the Advancement of Colored People, the American Federation of Teachers and the United Food and Commercial Workers Union, and another brought by Princeton University, Microsoft and a DACA recipient.

A wealthy Democratic donor club plotting the future of the liberal movement hopes to be fighting for reparations by 2022, according to a document obtained by the Washington Free Beacon from the Democracy Alliance's spring conference this week in Atlanta.

The desire was stated in the invitation for a Monday reception during the annual spring gathering, which was attended by top Democratic Party officials such as DNC chairman Tom Perez, former Virginia governor Terry McAuliffe, and Reps. Raul Grijalva (Ariz.) and Mark Pocan (Wis.).

The reception, "Way to Win: 2022 Victory Party," was presented as a look forward at what's possible if Democrats can be effective in coming elections.

"It's 2022 and we are celebrating policy victories across the nation: Medicare for All and Free College, and next on the agenda is Reparations," the group projected, according to an invitation to the event.

"Take a ride in our time machine to hear from the true political geniuses who made this happen," it says.

The group further predicts that the successful implementation of universal health care and free college will lead to more sweeping election victories, including the governorship in Texas and its electoral votes in the 2024 presidential election.

"Because we’re governing with gusto, we’re seeing victories up and down the ballot—including winning a governorship in Texas and putting 38 electoral votes in grasp by 2024," it says. "Stop in 2020 and 2019 when local power builders turned Arizona and Florida solidly blue and established Virginia as a progressive governance juggernaut."

The event was headlined with a speech by Georgia gubernatorial candidate Stacey Abrams, who the group predicted would "set the course for a new wave of leaders." She was pictured on the night of the event with McAuliffe, who was also a featured speaker at the conference and is considering a run for president in 2020.

Abrams has not publicly backed plans for universal health care or free college tuition, both policy positions supported by Sen. Bernie Sanders (I., Vt.). She has also not come out in support of reparations, a policy proposal that even Sanders has come out against.

Representatives for the DNC, which had a substantial presence at this week’s conference, did not respond to a request for comment on whether it thinks a push for policies such as reparations would be politically wise for the party.

The Democracy Alliance is the left's biggest donor club and has been embraced in recent years by party leadership. Its donor conferences have featured appearances by Democratic minority leader Nancy Pelosi and prominent Democratic senators such as Elizabeth Warren (Mass.) and Kamala Harris (Calif.).

The "2022 Victory Party" event was cohosted by a number of prominent liberal groups such as Planned Parenthood Action Fund, the Collective PAC—a collection of entities with a mission to build "black political power"—and the Women Donors Action Network, which seeks to leverage the power of progressive women donors.

The Solidaire Network, a group of wealthy liberal donors who foster protest and direct action, was also involved with the event. The Solidaire Network joined forces with two other liberal groups to form a "resistance" fund that combats "immediate threats" to "immigrants, women, Muslim and Arab-American communities, black people, LGBTQ communities, and all people of color" and push back against Republicans.

The Center for Popular Democracy, a New York-based progressive advocacy group, was also a cohost. The Center for Popular Democracy's sister organization, the Center for Popular Democracy Action Fund, leads a massive $80 million anti-Trump network that spans across 32 states.

Rep. Keith Ellison, the deputy chair of the DNC, last year publicly threw his support behind the network.

"This national network, led by working class people of color and immigrants, will supply the power and the fight we need to resist the Trump administration's all-out assault on American values," Ellisonsaid. "I look forward to standing with CPD Action's leaders in the streets and in Congress to win real progressive change."

The Center for Popular Democracy, which has partnerships with more than 50 left-wing activist groups across the country, is also funded by the Democracy Alliance, whose members each vow to steer hundreds of thousands in funding to approved groups of the secretive donor network.

Adm. Ronny Jackson, President Trump’s pick for Secretary of Veterans Affairs, allegedly gave out a large prescription of the opioid painkiller Percocet to a White House military staff member.

The White House medical staff was "thrown into a panic" when it could not account for missing supply of the drug. It later discovered Jackson had supplied a large amount to a staffer, and had private stocks of controlled substances, according to a report of allegations compiled by staff for Sen. Jon Tester (D-Mont.), the top Democrat on the Senate Veterans’ Affairs Committee.

Jackson has faced new setbacks in his path toward confirmation to run the VA. Reports over the last 48 hours have revealed allegations that Jackson improperly dispensed medication, drank too much on the job and created a hostile work environment while overseeing the White House medical unit.

The White House has stood by Jackson, who has served as a physician for each of the last three presidents, and defended his background and credentials.

President Trump’s personal lawyer Michael Cohen will assert his 5th amendment rights in the lawsuit filed against him by adult film star Stormy Daniels.

“Based on the advice of counsel, I will assert my 5th amendment rights in connection with all proceeding in this case due to the ongoing criminal investigation by the FBI and U.S. Attorney for the Southern District of New York,” Cohen said in a court filing Wednesday.

He cited the FBI raids on his residence, office and hotel room in his reasoning behind the decision.



Daniels, whose real name is Stephanie Clifford, is suing Cohen for defamation for suggesting that she lied about an alleged affair with President Trump.

There is strict international oversight to ensure and verify that Iran complies with the terms of the agreement, which they have done.
