***The Official Legalization of Cannabis Thread***

(Reuters) -Attorney General Eric Holder says federal authorities will continue toprosecute individuals for possession of marijuana in California even ifvoters there approve a ballot measure legalizing recreational use ofthe drug.


The Obama administration "strongly opposes"Proposition 19, Holder wrote in a toughly worded letter to former headsof the U.S. Drug Enforcement Administration who had written to himexpressing "grave concern" about the measure.

Passageof Prop 19 "will greatly complicate federal drug enforcement efforts tothe detriment of our citizens," Holder wrote in the October 13 letterobtained by Reuters on Friday.

"Accordingly,we will vigorously enforce the (Controlled Substances Act) againstthose individuals and organizations that possess, manufacture ordistribute marijuana for recreational use, even if such activities arepermitted under state law," he said.

Thetone and substance of the letter seemed at odds with a policy shiftannounced by the administration a year ago in its approach to medicalmarijuana, which California became the first U.S. state todecriminalize in 1996.

Reversingthe position taken by the Justice Department under President George W.Bush, the Obama administration said last October that federal attorneyswould no longer prosecute patients who use pot, or dispensaries thatdistribute it, for medical reasons in states where it has beenlegalized.

In his letter to nineformer DEA administrators, Holder said Proposition 19 language barring"state and local law enforcement from seizing marijuana that is incompliance with state law" would impede efforts to "target drugtraffickers who frequently distribute marijuana alongside cocaine andother controlled substances."

TheJustice Department is considering "all available legal and policyoptions" should the measure win enactment, he added. The issue couldvery well end up moot. A Reuters/Ipos poll on October 5 showedCalifornia voters leaning against the measure, 53 percent to 43 percent.

Ifpassed, California would become the first state to legalize simplepossession of an ounce or less of marijuana for anyone 21 or older. Itwould also be lawful to grow limited amounts of cannabis in one's ownhome for personal use.

While potsales would not be legalized outright, cities and counties could passtheir own laws permitting commercial distribution subject to localregulations and taxes.

StephenGutwillig, California director of the Drug Policy Alliance, which backsProposition 19, called Holder's comments political posturing, addingthat 95 percent of all U.S. marijuana arrests are made by state andlocal authorities.

"The federalgovernment may criminalize marijuana, but it can't force states to doso, and it can't require states to enforce federal law," he said in astatement.

i dont want it to be something like cigarettes where its mass produced with
chemicals and what not. let that *%+# be legal, let it grow where it grows

I think it will be illegal nationwide including cali before they'll ever make it legal nationwide,they're just testing it out and cali got lucky

From 2006 to 2008, African Americans were arrested for marijuana possession offenses in California’s 25 largest cities at at four, five, six, seven and even twelve times the rate of whites, according to a report released today by researchers at the Queens College, City University of New York and Shenandoah University in Virginia.

Among some of the California cities profiled:

* The City of Los Angeles, with ten percent of California’s population, arrested blacks for marijuana possession at seven times the rate of whites.

* San Diego, the second largest city in California, arrested blacks for marijuana possession at nearly six times the rate of whites.

* In Pasadena, blacks are 11% of the population but 49% of the people arrested for marijuana possession. Pasadena arrested blacks at twelve and a half times the rate of whites.

* In Sacramento, the state capitol, blacks are 14% of the city’s population but more than 51% of all the people arrested for possessing marijuana.

* San Jose, the third largest city in California, is only 2.9% African American. But San Jose arrested blacks for marijuana possession at more than five times the rate of whites. San Jose arrested 619 blacks per 100,000 blacks compared to 121 whites per 100,000 whites.

* The City of Torrance, with a population of 140,000, had the highest racial disparity of the 25 cities. Blacks are only 2% of the population but they made up almost 24% of the people arrested for marijuana possession. Torrance arrested blacks at over thirteen times the rate for whites.

These racially-biased marijuana arrests were a system-wide phenomenon, occurring in every county and nearly every police department in California,
