Rich Paul files motion to dismiss Nerlens Noel's lost earnings lawsuit


"NBA agent Rich Paul filed a motion to dismiss the lawsuit filed by Knicks center Nerlens Noel in August, arguing that their dispute should be arbitrated by the National Basketball Players' Association and that Noel has not paid him for negotiating a contract with New York before last season. Paul's motion was filed on Oct. 18 in Texas Northern District Federal Court.

Noel's lawsuit against Paul and Klutch Sports Group alleges they breached their duties to Noel and caused him to lose out on approximately $58 million in potential earnings. In the motion to dismiss, Paul and Klutch said that the terms of the standard player-agent contract with Noel require him to resolve any disputes via NBPA arbitration. Klutch should not be a party to the dispute at all because only individuals can represent players as agents, they argue.

In addition, Noel owes Paul earnings from negotiating a one-year, $5 million contract with the Knicks for the 2020-21 season, according to the motion to dismiss. Because the contract was negotiated prior to Paul and Noel ending their agent-player relationship in December 2020, Noel was required to pay Paul 4 percent of his earnings under their contract.

Paul filed a grievance against Noel with the NBPA in August regarding the pay dispute, according to the motion to dismiss. "Despite multiple written requests for payment, to date, Noel has failed to pay Paul any amount resulting from the Knicks (uniform player contract)," the motion states.

Noel responded to Paul's grievance and initiated his own arbitration case by filing his own grievance for breach of fiduciary duty, breach of contract, negligence and gross negligence, and breach of the duty of good faith and fair dealing. Their arbitration is currently pending before NBPA arbitrator and retired Judge Richard Levie.

Noel's lawsuit argues that Paul, as Noel's representative, "did little to no work" to secure contracts, pitch teams and land endorsement deals on Noel's behalf. In the complaint, Noel's attorneys say he lost out on a four-year, $70 million contract offer from the Dallas Mavericks after the 2016-17 season and "was instead forced to sign a series of qualifying offers and league minimum contracts which were well below the true value of Noel's services in the NBA marketplace."

The lawsuit seeks a declaratory judgment and monetary damages from Paul and Klutch Sports "in an amount to be proven at trial."
