Check out the Bobcats shorts with the jumpman on it...

As long as they are not selling them as merchandise, I guess the NBA wouldn't have a problem with it.

Actually, they DO sell Jordan Brand Bobcats apparel at the games. They advertise the heck out of it during timeouts.
