Payless did this with their shoes. If they were to legit open that store sell those shoes under the new label and price them as high end, there's absolutely nothing wrong with that.

If they’re selling the exact same shoes in Payless(which they are), yes, there is something wrong with that.
 
No...there really isnt. If it’s their product they can do whatever they want with it. If this was food or drugs, then maybe there’d be legal action. But in fashion anything goes.

This is basically the Gaps business model. Others have mentioned that the automotive industry does this too.

I think you're confusing what you think is morally right or wrong with what is legal or illegal...

Naw, it’s just false advertisement. They said they were a new luxury brand and they were actually an old discount brand. You can be sued for that.
 
So why hasn’t Gap been sued? Im seriously asking, because i think im just not understanding what you think is illegal.

you absolutely cannot be sued for opening a store and selling discounted merch at a premium. absolutely not. if i buy a hanes tshirt, then open a store selling them for $50 each (hi kanye) .... thats your fault for buying them. period. they really did open a new store. they really did sell merch. they put price tags on the items at whatever price they wanted cuz it was their store and their choice. all legal. i dont even see a moral issue with it. if someone is dumb enough to pay it.... youd better be smart enough to sell it.
