In a street sense, no. But in a LEGAL sense, this could be murder if the dude died. The robber was running away and and driver mowed him down for vengeance, not for protection. If the robber was running TOWARDS them with a gun, I think mowing him wouldve been justified legally, because it's considered protection at that point.
I just asked my friend that's an attorney and she said it could be considered aggravated assault.
If it goes to court, the judge would probably be as lenient as possible. Especially if the driver is white and the robber is black.
