To be honest, I'm not sure.

In Ebay, you can ask the guy who sold you it for a return of your shoe claiming that you scammed him. If he doesn't within a certain grace, he has to refund regardless of whether you plan on returning the shoes. After that, you guys go to the courts and stuff.
