He's not part of the fodder list since he has that special tech but hes definitely on the bubble since his weapons are guns. at least he can fly and be a decoy?

The OG one isn’t. It was made by the government(U.S. Air Forces) but WS destroyed that one in Captain America WS.

Once Sam became an Avenger he was on the Stark Industries payroll and got new upgraded wings from them.

Having just rewatched homecoming, tony seemingly wanted to have peter learn how to use the suit properly and incrementally

The shield is nice he perfected its use..
Caps a warrior. He would've gotten by with a gun and them hands.
Shields a government funded organization. They seem to have endless resources. They would've been fine without Tony especially if the real avengers were there with hank pym banner being the brains. Or if Reed was there.
