No Warrants Needed to Search Cars in PA Now

 
Pennsylvania police officers no longer need a warrant to search a citizen’s vehicle, according to a recent state Supreme Court opinion.

Probably not thread worthy but just wanted to give a heads up to those that are in the PA area. Im not 100% sure if it is effective immediately or not though.

You didn't need a warrant before; just probable cause. Which means that if the officer has articulable facts that he suspects more than likely criminal activity in your vehicle, he can search it. The state supreme court is just restating a precedent from the United States Supreme Court that's been law for a decent amount of time.

lol, you have a lesser reasonable expectation of privacy on a public vehicle than you do your own car; they need less for probable cause to search you on a bus!

Repped for truth. I'll add to this for anyone who has questions.

The reason for there being a lesser expectation of privacy is due to the fact cars are inherently mobile.  The likelihood that evidence can be moved or destroyed is much greater than that of your home. Plus you must consider that you do not live in your car, anyone can look through the windows (hence the lower expectation of privacy), hiding weapons and contraband is incredibly easy in a vehicle, the vehicle is used on public property and is regulated by the registry.

Not necessarily. If police officer has probable cause to search a personal vehicle, he can search the entirety of the vehicle, including any containers or bags, whereas if an officer wants to search a bus, the people on the bus and their belongings, he has to develop probable cause for or gain consent from each person and their belongings. Consent on the part of the bus driver/owner to search the bus does not extend to the passengers and their belongings. Legally speaking, the officer can't even feel the bags for anything they might think is illegeal without PC, a warrant or consent.

of course all it would take is reasonable articuable suspicion to perform a terry stop or pat down for weapons on any individual... granted the items then discovered would be subject to the plain feel doctrine
 
Drop a couple of reps In here, glad to see some folks know the law. Not as big of a deal as the title has one believe. It's the Pennsylvania Supreme Court.

This idiot knew he had bud in the car and consented to a search.
