I can see if it's someone using the same pics and it being a problem, but if he is using the description who gives a damn?

not much you can do, the seller seems to be legit he just doesn't use actual photo's, I'd let it go unless you are selling the same item on ebay using the same photo.
but you can report any item on ebay that you think is suspicious just click on Customer Service at the top of the ebay page and type in "Report a auction" and you can give a reason why you are reporting the listing.
