There's a difference.  The girl who accused Kobe had sex with her bf before Kobe, and Kobe did actually do what she accused him of.  Where it got muddled was whether the prosecutor thought they could convict him on rape.

Kobe asked her to go back door.  she said no but consented to regular sex. he asked again while they were having sex, she said no.  later during sex he did it anyway.  she didn't say anything.  after she went and filed a claim against him.

Correct me if I'm wrong, it's been years since I read that report.
