He just stated that he didn't state that he couldn't. Instead he is saying that lawyers advise you not to release them when you are under audit. So it is a decision he's making on the advice of counsel.

Either way his tax returns are going to be examined whether he likes it or not.
There are 3 congressional committees that have the authority to request Trump's tax returns. And they don't need the IRS' consent.
The House Ways and Means Committee, the Senate Finance Committee and the Joint Committee on Taxation all have this authority.
Furthermore, they can conduct an investigation and release it to Congress for public disclosure if they can provide a legitimate justification.
There is previous precedent for such disclosures after the GOP's IRS investigation into claims that the department discriminated against conservative organizations. The Treasury Inspector General concluded that the IRS used inappropriate criteria to identify organizations for review of tax exempt status.
The IG later stated that Republicans instructed the scope of his inquiry to "narrowly focus on Tea Party organizations".
A second Inspector General probe found that the problem was in fact more widespread and that inappropriate criteria were used against both conservative and liberal organizations.
House Republicans requested and disclosed the tax returns of 51 taxpayers as part of their IRS probe. So there is precedent for public disclosure.
