So, the people at Precious Moments aren't huge fans of my work.

I have a not-often-updated Precious Moments statue parody Tumblr called Preciouser Moments. I don't update it as often as I did originally (which is usually what happens). Yesterday I received essentially a cease and desist email from Tumblr. The email contained an attached email from Precious Moments. Here is an excerpt from the PM email.

It is the contention of the owner of the mark, Precious Moments, Incorporated (“PMI”), that some content displayed on Tumblr, specifically that posted by user Simon Fletcher is in fact the intellectual property of PMI and in direct violation of copyright and trademark law. The works displayed on URL http://preciouser-moments.tumblr.com are direct copies of copyrighted works crudely modified to form derivatives of copyrighted works used without the permission of the owner of said work.

Our mark “Precious Moments” is currently registered in several countries, including United States, Canada, Mexico, Brazil, China, Hong Kong, Japan, Taiwan, Singapore, Russia, Ukraine, United Kingdom, Indonesia and more. Registered copyrights for tangible products created using our artwork are recorded with the U.S. Copyright Office.
In the U.S., the trademark “Precious Moments” is currently registered under several numbers, based on various categories protected. Some include: 3731951, 3674981, 2284568, 4249413, and 4175562. Additional specific detail may be found on the U.S. Patent & Trademark Office website: www.uspto.gov.
By way of this letter PMI demands immediate removal of its copyrighted images, including but not strictly limited to the content identified herein, on all sites owned and operated by Tumblr, Inc., its parent companies, each of their affiliates and subsidiaries.
Under penalty of perjury, I hereby state the above information is accurate and true to the best of my knowledge. As an employee of Precious Moments, Inc., the rightful owner of the copyrighted works, I am authorized to act on the owner’s behalf.

I have them backed up. I haven't updated it since October though. That one totally couldn't be posted here.

I have a friend who is a lawyer. She tells me I don't need to take it down (too late, but I could always put them back up). Hell, even in the email from Tumblr they suggest I make it clear that my site is a parody account. Tumblr didn't tell me to take it down. I took it down because it seemed like too much trouble to fight for something I haven't updated in months. We will see.
