Just followed up with Roark, who said he doesn't think Kindle should be charged with "leaving the scene."
"If you run into another vehicle that has someone in it, and you fail to stop and give them your insurance information, you have committed the offense of leaving the scene.
"If you run into a stationary object and fail within a reasonable amount of time to contact the owner of the object and leave your information the best way you can, then you have committed the offense of leaving the scene.
"When you run into a stationary object, you've got a reasonable amount of time to do that. Management of the apartment was contacted within 12 hours of this happening. And they were told representatives of the driver were calling to pay for whatever damage had occurred.
"I don't think it's a criminal offense. He contacted them, or I did, at 10:30 a.m. that morning - eight hours - after the accident occurred. It's my opinion, you don't have an obligation to sit around and wait for anything else to happen. He did everything you would hope a young man would do, which is call and say, 'Hey, I ran into your building, and I'm either going to pay for it or my insurance is.'
"If he had wanted to leave the scene and not take responsiblity, he could have left the car there, ran away and claimed later on someone else was driving or his car was stolen or what have you. But they were called within 10 or 12 hours and told, 'We're sorry, we want to take care of the damage. We're sorry it happened, but it did. Tell us what we owe you, and we're going to pay you.' What more could you ask for from a person, especially one that's received a concussion.
"I would be concerned about him being charged because I think it would be wrong if he was. I don't think he committed a criminal offense. That's my position on it."
Roark strengthened his position on whether Kindle had been drinking that night.
"He (Kindle) told me he had not been drinking," Roark said.

NC State junior linebacker Nate Irving was injured in a car accident on Saturday night and is currently in the Wake Med Trauma Center with non-life threatening injuries.
Irving suffered a broken leg and a collapsed lung and is scheduled to undergo surgery on the leg on Sunday evening.
"Our thoughts and prayers are certainly with Nate and his family," said head coach Tom O'Brien. "All of his teammates and coaches will be there to support him as he recovers and goes through the process of rehabilitation."
Irving was an honorable mention All-ACC performer in 2008, despite missing almost a third of the season with injuries. He tied for third on the team with 84 stops.
