Him escaping Arkham is most likely what would've happened. Where else would they put him? A normal jail?

Obviously, I'm talking about the idea of him escaping Arkham and never returning or causing trouble depsite him going on a psychotic rant about how Batman completes him and he's an agent of chaos

I'd rather they just killed the character or just said he remains incarcerated

Thinking back at the trilogy, I believe one of the biggest reasons why the 3rd failed was that each film was created as a standalone. So there really was no concrete plan for the next installment. IMO, this really put them in a corner when developing the scripts. Storywise, they basically blew their load with Batman Begins. The idea of poisoning the water supply was originally the Joker's plan in The Man Who Laughs. The concept of freeing prisoners was actually Bane's plan for weakining Bats' in Knightfall. Bruce's backstory was from the Man Who Falls and Year One.

One of the positives of the entire trilogy is that they cross genres. Batman Begins is really the most superhero of all of them. And it actually had some light moments. The Dark Knight was a straight out crime drama and included post 9/11 sentiments. The Dark Knight Rises was more of a revolution/war film.

Who knows, maybe if Heath was still alive, Nolan and Co. would have come up with something special for a third, but just in terms of cherry picking from the comic books, they really exhausted a lot of the good Batman stories already.

But back to Leto, now that this photo has been released, I'm really anxious to see Robbie's HQ.

Joker might appear in BvS as a flashback:

Latino-Review have dropped some very interesting details about the ties between those two movies today, and it turns out that Jared Leto will be shooting scenes for both while in Toronto. They reveal that it will be a flashback scene which depicts The Joker beating Jason Todd, a.k.a. Robin, to death (presumably with a crowbar).

That will explain why he's behind bars and may even tie in with those rumours we heard a long time ago about Batman giving up crime fighting until Superman enters the scene. Robin's costume will be on display in the Batcave, and the site theorises that that could be what triggers the flashback. They also reveal that Bruce Wayne/Batman will be making an appearance in Suicide Squad, with the Batmobile reportedly on site in Toronto too.
