No, jailbreaking is not illegal. The most that will happen from it is apple will void the warranty cause your modifying it.

Putting cracked apps on it is illegal and 3rd party apps arent. Just cause you jailbreak doesnt you have to put cracked apps on there.

Unless you got the extended applecare warranty on it they wont replace it. Best you can try is to see if they can find and fix the issue withouthaving to 'repair' it cause their fees are as much as the phone is worth now.
