i honestly can't believe how many nters are saying the store owners are in the wrong.. sure the "protocol" might not allow them to put hands on the guy but the guy is a thief... the protocol is used because they don't want innocent customers being wrongly subdued... they know for a fact this guy stole so they tried to stop him yet yall are over there like "this ***** bout to get paid"... this is what's wrong with our generation.... and to the clowns making racist remarks... grow up


Just because the thief is in the wrong doesn't mean the employees can't also be in the wrong too to some extent.

As a former Lowes employee, we were told if we witnessed or thought someone was trying to shoplift, to go ask them if they needed help with anything. If they did take merchandise out of the store we were NOT allowed to follow/try and detain them. There was only one employee in the store that had that right, they were called a Loss Prevention something or another. Might sound stupid but thats what they told me when i was hired, not sure if the same applies at a gas station tho.

People here talking all sorts of nonsense about "law enforcement told me," "I used to work in retail," "we were told by management" as reasoning for why you believe you can't detain anyone or something isn't shoplifting unless you walk out the door, etc. Whatever your previous qualifications are doesn't mean anything, nor does it make what you were told correct--just read your state's penal code or the MPC, or some relevant case law. "Shoplifting," or petit larceny, doesn't hinge on whether one has successfully left the store. Detainment is generally lawful, so long as it's "reasonable,"--a court will have to determine the based on the facts. In this case, I suspect pummeling the suspect in the back of the store is probably unlawful, but everything up until that point, including the grabbing, biting and stripping, is probably fine.

And ninjahood, I was referring to intent to commit larceny, not intent for other crimes types, which is extremely complicated.
 
Barclays-area 7-Eleven clerks strip shoplift suspect in struggle over candy bar

A group of bold clerks at a 7-Eleven near Brooklyn’s Barclays Center were caught on a video dragging an alleged shoplifter back into the store after they claimed he tried sneaking out with a Snickers bar.

They then stripped down David Golson to nothing but his underwear — even giving the 29-year-old Bronx man a wedgie.

Golson — who has a long rap sheet — tried fleeing the convenience store at 395 Flatbush Avenue Extension around 11:15 p.m. Wednesday night with the stolen sweets after being confronted by the clerks, cops said.

The stunning scene – caught on a 3-minute video that were viral yesterday after being posted on the blog WorldStarHipHop – shows a nearly naked Golson screaming for help and trying to break free to run out of the store. And instead of getting to bite into the candy bar, he claimed one of the workers bit into him.

“I got nothing man! Why you biting me?!” he cried out to two uniformed clerks and a plainclothes worker as they ripped off his shirt, T-shirt and dropped his jeans to his ankles.

Sporting nothing but briefs, Golson had his underwear tugged up by the one of the workers who then took the torn T-shirt and draped it around Golson’s bottoms, clutching it with both hands so he couldn’t escape. The others clutched other parts of his upper body so he couldn’t get away.

Stunned passersby gasped through a store window giggling while a group of shoppers roaring with laughter recorded the incident.

“This is ridicuous — for some Snickers,” yelled one shopper watching. “This N---- has no clothes on ... “will somebody call the police.”

When cops arrived, they cuffed Golson – who had an outstanding warrant for an earlier arrest. They charged him with robbery, assault, criminal mischief and criminal possession of stolen property.

Police sources said the workers were not changed with any crimes because Golson tried to attack them and knock over shelves after they first approached him — something that wasn’t caught on the smart phone.

“That’s why he was hemmed up,” a source said. “They grabbed him, and prevented him from leaving the store. That’s why he ended up with his clothes off. They kept getting torn off as they tried to hold him.”

A 7-11 spokeswoman said the chain is “horrified about the video,” adding, “We do not condone restraining any customer.”

She said she “believes” Golson previously shoplifted in the shop.

One employee was fired while two others will be required to re-take a 7-Eleven training course, she said.

Lol too much fail in this story. Robber charged with all that, biting, corporate's statement, mandatory training course for the workers. Lmao

If I was there during this mishaps I wouldve grabbed a few things and walked out with them in my pocket. They were so concerned about this one guy that the next person wouldve gotten away clean. No doubt about it. I cant believe all this happened over one dollar and some change. Not to contradict my previous statement, but definitely petty on both ends. Especially the staff.
 

I second that. People go in the grocery store all the time and eat food that they are buying like a cookie out of the pack. I always think it's funny like, you can't wait until you get out of the store to have a cookie but whatever.

Nobody is getting tackled and bitten by a storeworker in the grocery store.
 
Technically, depending on how you look at it the store employees did a good job detaining the suspect but simple assault was commited and I would arrest the store employee and individual who is naked.

Not petty at all. It's not about the dollar amount of the item being stolen. Obviously, if they'd known the aftermath of what was about to go down, they'd probably let him walk, but shoplifters can't be given a free pass, on principle. Imagine if you had dudes repeatedly stroll into your store and said "IM GONNA STEAL THIS VITAMIN WATER AND IF YOU TRY TO STOP ME, IMA F*** EVERYTHING UP AND KNOCK EVERYTHING OVER." Would you let everyone do this?

Sometimes as a store owner, you have to take the L in standing your ground, despite knowing the the L is definitely not worth it. Is it ever worth the headache of even yelling or confronting someone who tries to steal a 10 cent Swedish Fish? Probably not, but you have to do it.

Everyone involved in this situation lame as hell. A grown *** man trying to steal a candy bar?? Why someone didn't just give them folks a $5 and pay for the stolen candy AND some?

I guess its that hard in the NYC streets.
