NYC Sportbike "gang" vs. Alexian Lien Thread vol. Let's Try this Again.

Enjoyed the convo, but I gotta go be productive :Nthat

EDIT: This is the actual law for the justification defense in New York.. I don't think it's as clear as you all are making it, but heck you may be right... Article 35..

Unless otherwise limited by the ensuing provisions of this article
defining justifiable use of physical force, conduct which would
otherwise constitute an offense is justifiable and not criminal when:
1. Such conduct is required or authorized by law or by a judicial
decree, or is performed by a public servant in the reasonable exercise
of his official powers, duties or functions; or
2. Such conduct is necessary as an emergency measure to avoid an
imminent public or private injury which is about to occur by reason of a
situation occasioned or developed through no fault of the actor, and
which is of such gravity that, according to ordinary standards of
intelligence and morality, the desirability and urgency of avoiding such
injury clearly outweigh the desirability of avoiding the injury sought
to be prevented by the statute defining the offense in issue. The
necessity and justifiability of such conduct may not rest upon
considerations pertaining only to the morality and advisability of the
statute, either in its general application or with respect to its
application to a particular class of cases arising thereunder. Whenever
evidence relating to the defense of justification under this subdivision
is offered by the defendant, the court shall rule as a matter of law
whether the claimed facts and circumstances would, if established,
constitute a defense.

I wouldn't have stopped until I saw cops.

you can tell dude lived a sheltered life, drove into Wash Heights thinking he'd have clear roads :{

There are also defense attorneys that are arguing the other side... Anywho, I really am more on the Lien guy's side. What the bikers did to him was awful. He is, however, an idiot. And he made poor choices which put his entire family in danger.
Whats wrong with yaw.

1. The dude brake checked which caused him to hit the biker OK.

2. The bikers get mad and hop off their bikers and started slashing his tires, breaking his windows, opens his door to drag him out.

3.RR driver speds off fearing for his life and runs over the bikers in the way who were blocking him

BIkers are wrong, they were impeding traffic and thats illegal

It isn't that you just "feel your life is in danger" (In that case anyone could be justified anytime by just saying they felt in danger)... There is something called a reasonable person standard... Would a "reasonable person" feel that their life was in danger because a biker slowed down in front of them? That's a question for a jury. My guess is that most people have encountered someone slowing in front of them to be a jerk and they haven't hit them and continued... Say your in the fast lane and a car is going 65 and you get all the way close and ride close to their bumper... If they don't like how close you are and decide to slow down to be a jerk, can you just hit them and keep driving?
what color is your bike?

If im the judge. Everyone of these bikers are getting minimal of 10 years in state pen. No mercy for these low life.

The economy must be getting better. Middle aged man living in a shoebox with his mom doesn't need $10,000.

LOL ninja hood would love that 10k

IF dude is really 30 and still haven't leave the nest yet then dude should take a long walk and reevaluate his life.

Give me 10k i can pay off some credit card debt right now. lol

So if you are "30" live in nyc and have a decent job but cant find reasonable places to live or rent, you wouldnt consider staying with your parents?
I quote 30 bc idk how old ninja is
But im 26 and know plenty of ppl in ny who live with their parents.

Judge me but id stay wit mom dukes ina heart beat.
Single family home, just her and my lil bro, 5 bedrooms, 2 car garage, big yard, cooked meals, and seeing my fam everyday.
I live in cali and pay all my fams bills back home, i wouldnt hesitate to move back and continue trend if the opportunity presented itself in the right fashion.
but then again, unlimited yams when u dont live at home.

Ps i aint denfending anyone but i do call it how i see it.
And i can see a lot of yall dont have any real genuine experiences in life.
Basically just school kids who went to college off of mommy and daddys hard work.
And think they know it all.

Man, then maybe your job isn't "decent" enough or you gotta move out of NY or move to North Jersey. No excuses to be living with ya parents over 25 unless you are saving for a down payment to buy a house. The fact that your family is living good is even more justification to get out on your own cause you know you have them to fall back on.

Once you hit 30 yrs old, the next stops are 35 and 40. You gonna say living with mombs at 40 is cool? I mean, what's your cutoff then since 30 is ok to you?

the first dude who put up the middle finger in court needs to get it for sure. All those old charges he had and never got the time he deserved :{. The system is f'd up

Son I'm sorry, but if a ****** ain't trying to reason with me even if I was in the wrong and threatened the livelihood of my family I don't care what te law, the streets or morals dictate, I'm gonna do everything within my power to defend them or die trying.....wouldn't be able to live with myself as a man if I sat back and did NOTHING while some punks beat me, my wife and my kid....ya gotta be kidding me.

I wanna see some clown in the heights disrespect mommahood and see how level headed ninja will be about it trying to talk it out...quit being hypocrites bros

He won't hear me tho...he's make threats here about simple things that shouldn't hold no weight in real life, yet goes off about how lien shoulda talked it out while dudes vandalize his car, wife and child in the car prolly scared to death....I mean if that's not the epitome of hypocrisy then what is?

Dont forget Cruz, the biker that brake checked the RR is catching a charge for false imprisonment... meaning in a court of law the RR was justified in his actions to do what he had to to escape the situation initiated by the biker.

Furthermore... if the rider is found guilty false imprisonment, Meises, the paralyzed rider will have a much greater chance of winning a civil case against Cruz who initiated the confrontation than Lein the driver of the RR who was merely trying to escape the potentially deadly situation. Unfortunately for Meises, Lein obviously has much more money than Cruz meaning if he wins the case he is still likely SOL when it comes payment time.

Sorry but if a group of 100 bikers surrounds my car with my wife and baby daughter in it, best believe I'm taking out a few of them at the very least.

Lien did the absolute right thing. Lock this thread up mods, nothing more to discuss here.

That's about it....

We're talking about someone who doesn't think rationally though.

Same person that literally said he didn't care who was on the road, he'd stop and talk to them about it because "thats what you're supposed to do".

Street code won't allow the paralyzed biker to do the logical thing and go after his riding mate, who he prolly don't eem know like that...lol

Hey bro I missed the number where you said the bikers did something wrong

7) why point out the obvious? They took it too far. It was a over REACTION to a unwise ACTION

8 ) just like Zimmerman should have never got out the car, end result was unnecessary

Lol are they really charging him with false imprisonment or are you just talking? :lol

Like I've bean saying since the beginning. Lien should have never drove that day. If he checked instagram and Twitter all of this could have been avoided.

a good lawyer or set of lawyers can prove false imprisonment by pointing out the bikers had surrounded the RR not giving any outlet to escape danger. Its illegal to stop on a highway, only in case of an emergency can you use the shoulder. No one signaled to move over to the shoulder of the highway

which led to the RR running over a biker out of self defense. I doubt the RR's intent was to run anyone over, but to get out of being surrounded by the mob.

if a good lawyer or set of lawyers puts that into legal terms. its over
