legally speaking: contracts can be terminated based on mistake of fact. if you allow the person buying to think it's an authentic product then you aredeceiving them and legally you are in the wrong. usually the amount would be too small to be taken to court which is why ebay turns its head to most of it.
but if you were taken to court you would probably be taken to another court for being in possession of fake items which violate a ton of trademark laws.

Its legal,BUT the actual company can make ebay shut your auction down if they catch it. But it makes no sense because I sold some authentic evisu jeans beforeand evisu contacted ebay and had them shut the auction down saying its was a trademark violation or some @%*+.Then i relisted them a week later and it was allgood.
